Understanding Impartiality and Fairness
Impartiality in family mediation means that the mediator remains neutral, not favouring any party over the other. Fairness involves ensuring that all parties have equal opportunities to voice their concerns, understand their rights and reaching a mutually acceptable agreement.
Here are some of the Key Strategies that we follow to ensure Impartiality and Fairness in our progressive mediation process.

Professional Training and Accreditation
At Mediate UK, all our mediators undergo significant training, alongside an accreditation process. Our family mediators are governed by recognised professional bodies, including the Family Mediation Council (FMC), which sits in the Ministry of Justice, and they adhere to their strict codes of conduct. This training helps equip our mediators with the skills to manage sessions impartially and ensure fairness in all interactions.

Structured Mediation Process
We follow a structured mediation process we call ‘Progressive Mediation’ that is transparent and consistent with getting results for our clients. This structure helps to:
- Ensure that each party has equal time and opportunity to present their views.
- Keep discussions focused, constructive and moving forward.
- Prevent any party from dominating the conversation.
- Ensure any agreements reached can be legally enforced if required.

Initial Individual Sessions
Before joint mediation sessions, we conduct initial individual sessions with each party. This meeting is called a MIAM (Mediation Information Assessment Meeting). These initial sessions allow the family mediator to understand the perspectives and concerns of each participant without bias.
It also provides a safe space for individuals to express any fears or anxieties, which can be addressed to ensure balanced participation in joint sessions. Additionally, the MIAM allows the mediator to assess whether there are any safeguarding issues that need to be addressed and to determine if family mediation is indeed a suitable approach for the situation.

Establishing ground rules for communication is important. At the start of the mediation process, our family mediators work with both parties to agree on rules that promote respectful and productive dialogue. These rules often include:
- Listening without interruption.
- Speaking honestly but respectfully.

Equal Opportunity to Speak
During mediation sessions, our family mediators ensure that both parties have equal opportunities to speak. This is monitored actively to prevent one party from overshadowing the other. Techniques such as “taking turns” and summarising each party’s points before moving on to the next topic help maintain balance. This does not mean that both parties need equal time to speak in a session. But they do need equal opportunity to speak.
Even in shuttle mediation, where parties are separated and communicate through the mediator, the mediator allocates equal time (typically in 15-minute increments) to each party to maintain fairness.
